Privacy notices for the use of the SaleSphere App provided by mVISE AG (“Data Privacy Statement”)

The protection of your personal data is of utmost importance for mVISE AG, Wanheimer Straße 66, 40472 Dusseldorf, Germany (“mVISE”). Therefore, our compliance with the stipulations of the Federal Data Protection Act (Bundesdatenschutzgesetz “BDSG”) and, as of 25 May 2018, with the EU Data Protection Basic Regulation is a matter of course for us. It is important for us to inform you which personal data will be collected, processed, and used by the App and which design options you have. This Data Privacy Statement provides you with the answers to the most important questions.

Section 1 Definitions

(1) “SaleSphere Website” refers to the marketing website of mVISE at the Internet address www.salesphere.com.
(2) “SaleSphere App” refers to the App under Android, which is connected to the SaleSphere Back End via login.
(3) “SaleSphere Back End” refers to the management of the customerrelated product data (client).

Section 2 Data Processing by mVISE

(1) By downloading, accessing or registering to the SaleSphere App (“SaleSphere App”) or by using or downloading its contents, you agree to this Data Privacy Statement.
(2) Before you can use the SaleSphere App for Android devices, you need a google account from Google Inc., 1600 Amphitheatre Parkway Mountain View, California 94043, USA. The privacy policy of the Google Inc. applies in this regard and can be found at: https://www.google.de/intl/de/policies/; by means of your google account you can obtain the app.
(3) Should you use the trial version of the SaleSphere App, the use of the SaleSphere App will be limited to the validity period of the trial version. Any data you uploaded to the SaleSphere App will be deleted after the trial period has expired, unless you have purchased the permanent SaleSphere App.
(4) For the permanent retrieval of content from the SaleSphere App and the permanent storage of your data on the SaleSphere Back End, you need to purchase a license for the use of the SaleSphere App. If you download the SaleSphere App without having already purchased a SaleSphere App license, you can only view selected contents. In case you are already a SaleSphere customer, you can log in with your user ID/password and use the SaleSphere App content after having entered your PIN.

Section 3 Which Data is Collected During Registration and How is it Used?

(e) Before submitting the registration, you must have confirmed the Terms of Use and have given your consent to the receipt of a validation email.
(f) To complete the registration, you will need to confirm the Data Privacy Statement and a validation email and set a password.
(g) Insofar as you order the newsletter, you will have to confirm the declaration of consent and a validation email.
(h) Afterwards, a personal SaleSphere Back End is created for you as the user, where you can upload your product data and invite new users.

Section 5 Which Data is Collected in the SaleSphere App and How is it Used?

After having logged in with the registration data on a client (Android) of the SaleSphere App, the customer can synchronize the product data with the Back End. This means that the customer has the current information stored on the back End. The complete content can also be downloaded to the client and must be updated manually or automatically, if required. An update without an Internet connection is impossible. A separate device ID is generated for each of your devices. This may change in case of a reinstallation of the concerned device.

Section 6 Information on the Data Processing on the Website http://www.salesphere.com/; Cookies

(1) Use of the SaleSphere Website
As a matter of principle, you can access and view the SaleSphere website under the URL http://www.salesphere.com/ without being asked to provide us with your personal data.
(2) Disclosure of Personal Data
This does not apply if you are our customer and log in to the SaleSphere Back End with your user name and password on the SaleSphere website.
(3) Cookies and Other Technologies
In addition, cookies can be set when you visit our SaleSphere website and also in our SaleSphere Back End. Cookies are small text files that are stored on the disk of your computer and allow your individual identification, but do not allow your person to be recognized. The following section explains in more detail the purposes for which these technologies are used.
(4) Analysis of the SaleSphere Website and of the SaleSphere Back End with Google Analytics
On the SaleSphere website and on the SaleSphere Back End we use Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google uses cookies. The information generated by the cookie concerning the use of the online offer by the user is generally transmitted to a server of Google situated in the USA where it is stored. The IP addresses transmitted by Google Analytics are not combined with any other data collected by Google.
Google will use this information on our behalf in order to evaluate the use of our online offer by users, to compile reports on the activities within this online offer, and to provide us with further services related to the use of this online offer and Internet use. The processed data can be used to create pseudonymous user profiles of the users.
We only use Google Analytics with activated IP anonymization. This means that Google will shorten the IP address of the user within the Member States of the European Union or in other States which are contracting party to the Agreement on the European Economic Area. Only in exceptional cases will Google transmit the entire IP address to a server in the US and shorten it there. The IP address transmitted by the user’s browser will not be combined with any other Google data.
Users can prevent the storage of cookies by setting their browser software accordingly; in addition, users can prevent Google from collecting the data generated by the cookie, which relate to their use of the online offer, and prevent Google from processing such data by downloading and installing the Google Analytics Optout Browser Addon available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de. Another option is to click here (hyperlink) to prevent the collection of data by Google Analytics. An optout cookie will be set which prevents the collection of your data during your visit the SaleSphere website and/or during the use of the SaleSphere Back End.

(5) Objection to Cookies and Similar Technologies
In general, you can prevent cookies from being stored on your hard disk by selecting “Do not accept cookies” in your browser settings. You can also set your browser so that it asks you whether you agree to this before setting cookies. Furthermore, you can also delete cookies at any time. Please read the instructions of your browser manufacturer for details. In case you use several browsers, you must set this Optout cookie in each browser. If you do not accept cookies, this may lead to functional restrictions of the SaleSphere website or the SaleSphere Back End in individual cases. In case you delete a cookie, you have to activate the Optout link again.

Section 7 Data Transmission Only Within the EU

Your data is only processed within the European Union. At present, a transmission of your personal data to third countries is not carried out and not planned.

Section 8 Transmission of Your Data to Third Parties

In certain cases, e. g. in case of a corresponding court order, we are legally obliged to transmit data to a requesting governmental authority or a third party. Beyond that, we do not transfer any data to third parties unless you have given your express consent.

Section 9 Information

(1) You can request information about the extent, origin, and recipients of the stored data as well as the purpose of the storage free of charge.

Section 10 Changes to the Privacy Policy

We may change this Privacy Policy at any time by publishing the amended terms and conditions. We will notify you in due time in case of significant changes, e.g. within the scope of software updates.

Section 11 Rectification of Your Data

In case incorrect information is stored despite our efforts to ensure that the data is correct and uptodate, it will be rectified at your request.

Section 12 Data Deletion, Data Blocking

The time limits for record retention and deletion of personal data are not the same. In case of existing regulations, we comply with the obligation to delete your data as a matter of routine. Connection data will be deleted after use. Your contact data will be deleted immediately after your objection or revocation, unless there are other legal time limits to the contrary. Should a deletion be impossible due to technical, organizational or statutory reasons, your data will we blocked for further processing or use.

Section 13 Data Security

We use technical and organizational security measures to protect your data administered by us against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons. Our security measures are continuously improved in line with technological developments.
